Er Rational musings #466

Er Rational musings #466

Illegal buildings are a menace. It's a crime to pay for, possess and stay in unauthorized buildings. The land on which an apartment is built should be 'legal', in all respects. Else, occupants should be prepared for any eventuality, if they knowingly or even unknowingly have bought flat in such buildings.

One question in my mind...

As a new, prospective flat buyer, can any one take following actions, before investing / buying new or re-sale property:

Generally, we see a Public Notice in leading, local language and English daily newspaper, asking / inviting objections from general public. A reasonable notice period is mentioned. eg 30 or 90 days from date of public notice. After the expiry of notice period, any objection is considered null and void.

On similar lines, can anyone

~ Write a letter (and sent by Registered AD), to various departments of Govt of India, State Govt, Local Municipal body and others like MIDC, CIDCO, MMRDA, MoEF, along with a copy of the property draft agreement, asking them as well, if anybody has objection to the said premises being bought. Mentioning a notice period, and if nothing happens in the notice period, buy the property. So, for the rest of their life, flat owners can stay peacefully in the flat.

Don't know the legality...
